Liability Waiver & Indemnity Agreement

This Agreement is made between the individual guest (“the Guest”) and Coconut Yachts, including its officers, employees, crew members, and agents (collectively, “the Company”). By boarding the vessel or utilizing any equipment provided by the Company, the Guest acknowledges and agrees to the following:

1. Assumption of Risk

The Guest understands that maritime travel, swimming, and the use of water sports equipment (including but not limited to SeaBobs, paddleboards, kayaks, and floats) involve inherent risks. These risks include, but are not limited to:

  • Changing weather and sea conditions.

  • Physical injury from slips, falls, or equipment usage.

  • Risks associated with swimming in open water and interaction with marine life.

  • Natural disasters or navigational hazards.

The Guest voluntarily assumes all risks, both known and unknown, associated with the charter experience.

2. Physical Health & Safety

The Guest warrants that they are in good physical health and free from any medical conditions (including heart conditions, respiratory issues, or pregnancy complications) that could be aggravated by maritime motion or physical activity.

  • Safety Briefing: The Guest agrees to attend the mandatory safety briefing upon boarding and follow all instructions provided by the Captain and Crew.

  • Life Jackets: Use of life jackets is mandatory for all children under 12 and non-swimmers while the vessel is in motion or at the Captain’s discretion.

3. Alcohol and Conduct

  • Consumption: Alcohol is consumed at the Guest’s own risk. The Guest acknowledges that alcohol consumption impairs balance and judgment in a maritime environment.

  • Liability: The Company is not responsible for any injury, loss, or damage sustained while the Guest is under the influence of alcohol or any other substance.

  • Termination: The Captain reserves the right to restrict alcohol consumption or terminate the charter immediately if a Guest’s behavior becomes a safety risk to themselves or others.

4. Release of Liability

To the maximum extent permitted by the laws of Singapore, the Guest hereby releases, waives, and discharges Coconut Yachts from any and all liability, claims, or demands for:

  • Personal injury or wrongful death.

  • Loss of or damage to personal property (including jewelry, electronics, and cameras).

  • Indirect or consequential losses arising during or after the charter.

This release applies whether the injury or loss is caused by the negligence of the Company or otherwise, excluding cases of proven gross negligence.

5. Indemnification

The Guest agrees to indemnify and hold harmless Coconut Yachts against all claims, actions, costs, and expenses (including legal fees on an indemnity basis) arising from:

  1. The Guest’s breach of safety protocols.

  2. Any damage caused by the Guest to the vessel’s interior, upholstery, or technical equipment.

  3. Any third-party claims resulting from the Guest’s conduct.

6. Minors and Dependents

Where the Guest is accompanied by minors (under the age of 18), the Guest assumes full responsibility for the safety and conduct of said minors and agrees to the terms of this waiver on their behalf.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the Singapore courts.
